Silicon Valley’s most high profile case opened last week, with the creators of Fortnite presenting expert evidence that portrayed Apple’s ecosystem as a “walled garden”. Epic Games’ lead expert economist, Global Economics Group Chairman David Evans, offered the court his views on several key aspects of the case, including the definition of the market, how smartphones aren’t substitutes for consoles and more. The appeal is part of a five-year legal saga involving Mr Oygur and his business, who were both sued by Deckers in 2016. The defendant obtained expert evidence that the term “Ugg” was already being used in Australia in the 1960s and became a generic term throughout the US shortly after.
